In the State of Florida, I was curious about how much negligence was based by the insurance. If a driver and the person crossing the street does not see one another and they are the only two people in the road where does that leave the parties at fault. I don’t believe a party should get more negligence than another. I think it should be half. What are your thoughts? Especially, when the driver who hit the pedestrian in the cross walk denies the truth about what happened and the pedestrians is the one whom knows how he got hit but, suffered over $40K in medical bills and home care recovery.

    Thank You.
